The Government approves the dossier to develop the Decree on Personal Data Protection


On March 7, the Government issued Resolution 27 approving the dossier to develop a Decree on Personal Data Protection.

In Resolution 27 signed by Deputy Prime Minister Vu Duc Dam on March 7, the Government agreed to regulate that personal data is processed without the consent of the data owner in 5 cases, including: processing is necessary to respond to an emergency that threatens the life, health or safety of the data subject or other individual. Data Controller, Data Processor, Data Controller and Processor, Third Party is responsible for proving this case.

The disclosure of personal data in accordance with the law; The handling is necessary because of national defense and security requirements, and is carried out by competent authorities in accordance with other laws; Competent state agencies investigate and handle law violations according to the provisions of law; Personal data is processed by a competent state agency for the purpose of serving the operation of the state agency in accordance with the law.

Previously, on September 29, 2020, the Government issued Resolution 138 approving the proposal to develop a Decree on Personal Data Protection, assigning the Ministry of Public Security to assume the prime responsibility for, and coordinate with other ministries, agencies and localities Relevant agencies to research and develop a Decree on protection of personal data and submit it to the Government.

Developing and submitting to the Government a draft Decree on protection of personal data and guiding documents is one of the tasks the Government has assigned to the Ministry of Public Security in Resolution 17 of March 7, 2019 on a a number of key tasks and solutions for the development of e-Government in the period of 2019 – 2020, with a vision to 2025. This is a key task, ensuring the legal element for the implementation of personal data protection in Vietnam. our country and ensure the operation of e-Government.

In the draft report submitted to the Government on the proposal to develop a Decree on Personal Data Protection, the Ministry of Public Security emphasized the need to develop and issue a Decree on Personal Data Protection. According to this agency, in the current digital technology era, especially with the strong development of breakthrough technologies in the industrial revolution 4.0, the issue of protecting personal data is becoming more and more important. should be urgent both in the world and in Vietnam.

Vietnam is one of the countries with the highest Internet application and development speed in the world, with a large number of Internet users in Vietnam. The digital infrastructure is evolving rapidly and the data infrastructure is improving. The Government is drastically directing to promote the building of e-Government, towards digital government and digital economy and has achieved many important results.

However, the higher the level of technology application, the greater the provision and use of personal information. This poses a problem for the Government to manage effectively, to prevent and handle violations of the law on personal information; at the same time, ensuring compliance with the Constitution, provisions of Vietnamese law as well as international law.
